PackoLoopo Terms of Service

1. General

  1. PackoLoopo is operated by POWER Rubber Robert Piotrowski, Moszna-Parcela 55A, 05-840 Brwinów, Polska, CEIDG, NIP 5342331435, REGON 365271408, VAT PL5342331435, contact: kontakt@packoloopo.com.
  2. PackoLoopo is a listings board where businesses and private persons in European Union countries give away or sell used packaging (cardboard boxes, jars, egg cartons, pallets, crates and similar) for local pickup.
  3. PackoLoopo is not a party to agreements between users, does not handle payments and does not inspect packaging before pickup.
  4. Using the service is free of charge.
  5. These terms are governed by Polish law. Consumers keep the protection of the mandatory laws of the country where they live.

2. Account

  1. You create an account with Google, Facebook, Apple or a link sent by email. You must be at least 16 years old.
  2. An account is personal. A business posting listings marks the account as a business account and gives its real name.
  3. You can delete your account at any time under My account. We delete your listings, photos and bookings with it.

3. Listings

  1. A listing must concern packaging that is actually available and state the real quantity, condition, pickup place and price for the whole lot (0 = free).
  2. Not allowed: packaging that contained hazardous substances (e.g. chemicals, fuels, plant protection products); contaminated or dirty packaging offered for food without saying so; items that are not packaging; goods whose sale is prohibited; misleading, offensive or advertising content; other people's personal data.
  3. Photos must show the packaging offered and must not infringe the rights of others.
  4. Limits: 10 listings per day and 6 photos per listing. Listings cannot be edited: to change something, delete the listing and add it again.

4. Booking and pickup

  1. The person booking chooses a pickup slot from the hours given in the listing. After booking they see the exact pickup address.
  2. Either side may cancel a booking. Please do so in good time.
  3. After pickup, one of the sides confirms the pickup in the service.
  4. The parties to a listing are responsible for the condition of the packaging, transport, safety during pickup and payment.
  5. Asking for advance payments, card details or any other payment before pickup is prohibited.

5. Liability

  1. PackoLoopo stores content added by users. We are not liable for it as long as we do not know that it is illegal. Once we receive substantiated information, we block it without delay (Article 6 of the Digital Services Act, DSA).
  2. We are not responsible for how a pickup goes or for agreements between users.

6. Reporting content

  1. Anyone, also without an account, can report a listing with the “Report” button on the listing page.
  2. A report contains the reason, an explanation of why the content is illegal or breaches these terms, and a statement that the report is accurate and made in good faith. People without an account also give their name and email address.
  3. We handle reports without undue delay, carefully and objectively. If an email address was given, we inform the reporter of our decision.

7. Moderation and its consequences

  1. Reports and content are reviewed by people. We do not make automated decisions.
  2. If content is illegal or breaches these terms, we may hide the listing (an active booking is then cancelled) or block the account. A blocked account cannot add listings or bookings.
  3. We block accounts for serious or repeated breaches, in particular for fraud.
  4. The author always receives a statement of reasons: what we did, why, on the basis of which law or clause of these terms, and how to appeal. It is shown under My account.
  5. If someone frequently submits manifestly unfounded reports, we may, after a warning, stop handling their reports for a set period.
  6. We inform the competent law enforcement authorities about content indicating a criminal offence that threatens people's life or safety.

8. Appeals and complaints

  1. You can appeal a moderation decision, or complain about the service, within 6 months by writing to kontakt@packoloopo.com.
  2. The appeal is decided within 14 days by a person who did not take the original decision. If it is justified, we restore the listing or unblock the account.
  3. You may also use a certified out-of-court dispute settlement body (Article 21 DSA) or the courts.

9. Order of listings

Listings are shown in the order the user chooses: by distance, date added, price or quantity. There is no paid promotion of listings.

10. Point of contact

11. Changes to these terms

We announce changes on the website and by email at least 14 days in advance. If you do not agree, you can delete your account.
