PackoLoopo Terms of Service
Version of November 6, 2026.
Draft. It will be reviewed by a lawyer (including US counsel) before launch.
1. General
- PackoLoopo is operated by POWER Rubber Robert Piotrowski, a sole proprietorship registered in Poland (European Union), Moszna-Parcela 55A, 05-840 Brwinów, Polska, CEIDG, NIP 5342331435, REGON 365271408, VAT PL5342331435, contact: kontakt@packoloopo.com.
- PackoLoopo is a listings board where businesses and individuals in the European Union, Norway and the United States give away or sell used packaging (cardboard boxes, jars, egg cartons, pallets, crates and similar items) for local, in-person pickup.
- PackoLoopo is not a party to any agreement between users, does not handle payments and does not inspect packaging before pickup. Each pickup is a direct arrangement between the user who posted the listing and the user who booked it.
- Using the service is free of charge.
- These terms are governed by Polish law. Consumers keep the protection of the mandatory laws of the country or state where they live. [To be confirmed by counsel for US users: governing law, venue/forum and any state-specific consumer provisions.]
- [Note for counsel: these terms intentionally contain no arbitration clause or class action waiver. Decide whether one should be added for US users.]
2. Account
- You create an account with Google, Facebook, Apple or a sign-in link sent by email. You must be at least 18 years old to use PackoLoopo in the United States.
- An account is personal. A business posting listings marks the account as a business account and provides its real name and VAT or tax identification number. We may ask for confirmation of the business details; until then the account may be shown as a private account.
- You can delete your account at any time under My account. Your listings, photos and bookings are deleted with it.
3. Listings
- A listing must concern packaging that is actually available and must state the real quantity, condition, pickup location and price for the whole lot (0 = free).
- Not allowed: packaging that contained hazardous substances (e.g. chemicals, fuels, pesticides or other plant protection products); contaminated or dirty packaging offered for food use without saying so; items that are not packaging; goods whose sale is prohibited; misleading, offensive or advertising content; other people's personal information.
- Account names, business names, listings and stories must not contain links, email addresses or phone numbers (exception: the pickup note, which only the person who booked can see), profanity, or names impersonating PackoLoopo or its support team. The service checks this automatically, and listings with typical signs of fraud (e.g. a request for an advance payment, a payment code or shipping by courier) are sent to a moderator for review.
- Photos must show the packaging offered and must not infringe anyone else's rights. By adding photos and a description, the author confirms that they hold the rights to them and allows PackoLoopo to display them in the service free of charge for as long as the listing is published.
- A new listing is checked automatically before it is published (usually within a few seconds). If there is any doubt or a risk signal, a moderator reviews it (usually within 24 hours).
- A listing is visible for 30 days, and a recurring listing for 90 days. The author can renew it under My account. A listing that is not renewed expires and disappears from search and the map.
- Limits: 10 listings per day, 6 photos per listing and 60 photos per account. Listings cannot be edited: to change something, delete the listing and post it again.
- Weights and environmental impact figures shown in the service (e.g. the estimated amount of packaging reused) are estimates for information only and are not guaranteed.
4. Booking and pickup
- The person booking chooses a pickup time slot from the hours given in the listing. After booking, they see the exact pickup address.
- Either side may cancel a booking. Please do so in good time.
- After pickup, one of the sides confirms the pickup in the service: the author of the listing at any time, and the person who booked no earlier than one hour before the chosen time slot. A booking that nobody has confirmed or canceled expires one day after the time slot, and the listing becomes available again.
- The pickup is a direct arrangement between the users. The users involved are responsible for the condition of the packaging, transportation, safety during pickup and any payment.
- Asking for advance payments, payment codes, gift cards, card details, login details or any other payment before pickup is prohibited. PackoLoopo never asks for payment or card details – any such request is a fraud attempt and should be reported.
5. Liability
- The user who added listings, photos or other content is responsible for it, in particular for its compliance with the law and these terms, its accuracy, and any infringement of copyright, publicity rights or other rights of third parties.
- PackoLoopo stores content added by users. We are not liable for it as long as we do not know that it is illegal. Once we receive substantiated information that it is, we block it without delay (Article 6 of the EU Digital Services Act, DSA, which applies to us as an EU-based operator).
- A user who, through their own fault, added content that is illegal or breaches these terms shall compensate the damage it causes to other persons and to the operator of the service, including the costs of justified claims brought against the operator by third parties because of that content.
- We may hide or remove content that breaches the law or these terms. We may keep a copy for as long as required by law, by proceedings of public authorities, or for establishing, exercising or defending legal claims.
- We are not responsible for how a pickup goes, for the condition of the packaging or for agreements between users.
- Toward users who are businesses, we are not liable for lost profits. Nothing in this section excludes liability that cannot be excluded by law, in particular toward consumers and for damage caused intentionally. [To be confirmed by counsel for US users: disclaimers of warranties and limitation of liability wording.]
6. Reporting content
- Anyone, including people without an account, can report a listing with the “Report” button on the listing page.
- A report includes the reason, an explanation of why the content is illegal or breaches these terms, and a statement that the report is accurate and made in good faith. People without an account also provide their name and email address.
- We handle reports without undue delay, carefully and objectively. If an email address was provided, we inform the person who reported of our decision.
7. Moderation and its consequences
- Because PackoLoopo is operated from the European Union, we follow the moderation process of the EU Digital Services Act (DSA) for all users, including users in the United States.
- New listings (title, description and photos) are pre-screened by an automated tool based on an AI model. It may publish the listing, refer it to a moderator or hide an obvious violation – the author then receives a statement of reasons and can appeal; an appeal is always decided by a person. Reports from users are reviewed by people. A listing reported by two different people is temporarily hidden until a moderator decides.
- If content is illegal or breaches these terms, we may hide the listing (any active booking is then canceled) or block the account. A blocked account cannot add listings or bookings.
- We block accounts for serious or repeated violations, in particular for fraud.
- The author always receives a statement of reasons: what we did, why, on the basis of which law or clause of these terms, and how to appeal. It is shown under My account.
- If someone frequently submits manifestly unfounded reports, we may, after a warning, stop handling their reports for a set period.
- We inform the competent law enforcement authorities about content indicating a criminal offense that threatens people's life or safety.
8. Appeals and complaints
- You can appeal a moderation decision, or file a complaint about the service, within 6 months by writing to kontakt@packoloopo.com.
- The appeal is decided within 14 days by a person who did not make the original decision. If it is justified, we restore the listing or unblock the account.
- Under the EU Digital Services Act, you may also use a certified out-of-court dispute settlement body (Article 21 DSA). This option is available to all users, including users in the United States. You may also go to court. [To be confirmed by counsel for US users: dispute resolution and venue.]
9. Order of listings
Listings are shown in the order the user chooses: by distance, date added, price or quantity. There is no paid promotion of listings.
10. Point of contact
Users: kontakt@packoloopo.com. Authorities of the EU Member States, the European Commission and the European Board for Digital Services: kontakt@packoloopo.com. We communicate in English, Polish and German.
11. Changes to these terms
We announce changes on the website and by email at least 14 days in advance. If you do not agree, you can delete your account.
